Vineet Nagla heads the Taxation practice at the Firm, with a special focus on GST, Customs, State levies, erstwhile Central Excise, Service Tax, VAT and Central Sales Tax as well as regulatory advisory under the Foreign Trade Policy. Vineet has substantially assisted clients to address complex financial issues under the GST regime with a sector-specific focus on Real Estate, Hospitality and Service, Shipping and Gems and Jewelry business. Vineet is a qualified Chartered Accountant and Company Secretary and is currently pursuing Bachelor of Law (LLB).

With over 13 years of taxation expertise, Vineet has executed crucial assignments relating to transaction structuring as well as litigation matters for various Indian and multinational corporations. Vineet has worked extensively on issues relating to CENVAT Credit, Excise classification issues, Customs valuation and assisting clients in maintaining requisite documentation for Government audits. Vineet has extensively worked with various pre-eminent Industry Associations and offered his proficient advisory services while successfully representing such associations' interests before the Central Government and State Governments for grant of reliefs arising from concerns faced under various tax-related legislations.

Vineet has also been pioneering expertise in the set-up related and ancillary issues associated with business incorporation and management at the Special Economic Zones (‘SEZ’).

Prior to joining the Firm, Vineet was part of the tax team at Economic Laws Practice and Deloitte.

Goods and Services Tax (GST)

GST Implementation
  • Assisted, advised and provided extensive hands-on support to various leading companies engaged in sectors such as real estate and infrastructure, media and entertainment, gems & jewelry, shipping & logistics, FMCG and manufacturing entities amongst others for a seamless transition to the GST regime.

Government advocacy under GST

  • Assisted and represented Industry Associations engaged in sectors such as real estate, gems & jewelry, FMCG and music industry amongst others in making representations to the Ministry of Finance (India) and GST Council for lower / benign GST rates.
  • Successfully represented numerous real estate organizations for certain issue-based matters including but not limited to taxability of transfer of development rights, point of taxation and valuation of barter transactions, reversal of input tax credit pertaining to sale of flats post completion certificate amongst others.
  • In bonafide association with the Ministry of Shipping, the Government of India – Vineet has also successfully represented various maritime training institutes before the Central Board of Indirect Taxes and Customs (CBIC) and GST Council for issuance of clarification regarding GST exemption on courses conducted by such institutes.
  • Assisting a leading FMCG conglomerate in representation before the CBIC and GST Council for issuance of clarification regarding appropriate GST classification for various products.

Ongoing support under GST

  • Providing ongoing assistance and advisory support to leading corporations in relation to corporate taxation.

Litigation under GST and other State levies

  • Successfully represented a leading distillery company before appellate authority on an issue concerning evasion of State Excise duty.
  • Represented a Writ Petition to challenge taxability of ocean freight under the reverse charge mechanism under GST.
  • Advised an infrastructure and construction company in filing Writ Petition to challenge validity of Section 86A of the CGST Act and successfully seeking de-freezing of GST electronic credit ledger.

Erstwhile Indirect Taxation Regime

  • Handles litigation matters – at both adjudication and appellate levels pertaining to the erstwhile indirect taxes including but not limited to drafting and filing of: (i) Statutory correspondences such as show cause notices, (ii) Appeals to the Customs, Excise and Service Tax Appellate Tribunal (‘CESTAT’) (iii) Writ Petitions with various High Courts and (iv) Affidavit-in-rejoinder and other Regulatory applications.
  • Representing various companies before the Supreme Court in pending matters regarding levy of Service Tax on commission received from related overseas entities.
  • Providing assistance and litigation support to entities availing area-based exemption.

Customs and Foreign Trade Policy

  • Representing a reputed FMCG group before the CBIC to obtain a clarification in relation to the classification of a product under the Customs Act, 1962. Advised and successfully represented the client in obtaining a waiver from furnishing bank guarantee on import of the subject chemicals.
  • Assisted clients in obtaining refunds of IGST paid on exports in case of difference in value reported in shipping bills and GST returns.
  • Regularly assists and advises various leading conglomerates in the filing of the SEIS, MEIS and EPCG license applications and making representations to the Directorate General of Foreign Trade (DGFT) for issuance of the scrips under such schemes.
  • Expertise in setting up, providing handholding support and exit advisory from SEZ scheme.
  • Provided litigation support to leading companies engaged in FMCG, hospitality, pharmaceuticals and infrastructure sectors with respect to issues concerning duty credit scrip under SEIS.
  • Instrumental in obtaining favorable ruling pertaining to applicable rate of CVD on imports from SEZ to Domestic tariff Area (‘DTA’) units.
  • Assisted clients in importing advisory for undertaking project imports, applicability of terminal excise duty and deemed exports under customs and FTP regulations.
  • Effectively undertook a comprehensive review of Customs classification of products imported and exported by a leading pharmaceutical company.
